COA throws out police, govt bid to strike out Indira Gandhi's suit By Raveena Nagotra

Malaysiakini : The police and government have failed in their bid to dismiss M Indira Gandhi’s lawsuit over the authorities’ alleged failure to arrest her Muslim convert former husband and recover their daughter Prasana Diksa.

The Court of Appeal in Putrajaya today unanimously decided to uphold last year’s Kuala Lumpur High Court ruling by judge Mohd Nazlan Mohd Ghazali to dismiss the striking-out application by the appellants.

“We are of the view that the learned High Court judge was correct in his finding that whether the appellants were liable for the tort of nonfeasance as alleged by the respondent is a matter of evidence which must necessarily be dealt with by way of trial.

“We are of the conceded view that based on the facts and circumstances of this case, there are complex issues of law including issues on the interpretation of Section 7(2) of the Government Proceeding Act, Section 20 of the Police Act and also the common law positions of the tort of nonfeasance by the public officer,” ruled Court of Appeal judge Hanipah Farikullah.

apanama is back : Good. Kudos to Judge Nazlan of HC and the three COA judges. M Indira Gandhi - 4, government of Malaysia - 0. If the the government appeal to FC, the score could be 9-0 or 11-0, favouring Indira. 

A delaying tactic is being used by police, HM and government of Malaysia by using court process to avoid looking for her daughter, Prasana Diksa and arrest her former muslim convert husband. What will happen after the score as what I mentioned above? 

If the police still refuse, bring them to court for contempt? The police will drag their feet and may even disrespect the 9 or 11 judges' verdict All these happen because of ketuanan melayu's maruah is at stake. It should be guarded at all cost, even at the expenses of being disrespect to court's verdict. 

However, I salute Indira's stamina, grit and determination to continue her fight. At last mother's love will ultimately win! I am very sure about it. Just wait and see. She will be re-united with Prasana.

Fair Play : The separation of power under the three branches of government. Our last HOPE is the Judiciary because under the present setup, Parliament the first branch is also the part of the second branch, the Executive, especially when the Executive control the majority of the members of the first branch. There is now more than hope and the future is beginning to take shape.

EQUALIZER121 : When come to catching opposition police are so zealous and go on overdrive.. to apprehend them but when comes to cases like this right from the IGP to the policeman they act like mentally retarded and unable to comprend the courts order what to do Budak Kita ...this is Ketuanan Melayu stupidity at it peak

MarioT : There is hope for the country with decisions like this one Criminality encouraged by the power that be, should not be condoned or allowed to prevail 

A mother lingering in suffering and mental torture shown no recourse on religious grounds. I have known cruelty shown in war, criminal acts, political rivalry and totalitarian systems but if such a behaviour is shown by religious authorities then what is the difference ?
