Tax exemption legal tussle: Prove it, Muhyiddin tells Guan Eng By Hariz Mohd

Malaysiakini : Former prime minister Muhyiddin Yassin wants Lim Guan Eng to prove in court that the Finance Ministry did not revoke Albukhary Foundation's tax-exempt status.

In his defence statement against Lim's civil suit, the Bersatu president expressed his doubt over the veracity of the ministry’s statement last month saying the ministry nor its officers had revoked the exemption.

"Save that Finance Ministry on March 23, made a press statement stating that neither the former finance minister nor its officer had revoked the tax exemption given to Al-Bukhary Foundation, the defendant does not make any admission to paragraph 28 of the statement of claim.

"The defendant denies the veracity of the statement made by the Finance Ministry on March 23 and put the plaintiff to strict proof," said the defence statement filed by Muhyiddin's lawyer yesterday.

Siva1967 : How is it possible to provide ‘Strict Proof’ of something that did not take place? The point of this whole fiasco is that TSMY accused LGE that he revoked the tax exemption for this tycoon’s foundation or company or whatever.

Yes, exemptions will only be accorded for the rich and for ordinary people like you and I we will be taxed to the max and be penalized for not adhering to some regulations. And no, we mere mortals cannot apply of tax exemption. Anyway, back to the matter. LGE gave a specific time frame for SMY to retract or face legal action which eventually LGE did.

Now TSMY through his lawyers is asking LGE to prove on something he (TSMY) claimed had taken place. Who is the dunggu here? When someone accuses a person and/or an establishment of committing something, the burden of prove is on the accuser and not the accused.

Either TSMY thinks the rakyat are fools or his lawyers are taking us for fools. Either way, thank God, TSMY was not made PM10 after GE15. If this is the quality of the ex-PM how low would his cabinet be.

Cogito Ergo Sum : Muhyiddin was Home Minister when LGE was Finance Minister at that time. Why did not Muhyiddin raise the matter during their Cabinet meetings?

And now, he is alleging that officials at the FM are lying? This man so desperate to regain lost support, he resorts to blatant lies to create doubt. But it had been his modus operandi for a long time.
