KUALA LUMPUR, June 3 ― The police officers under investigation for allegedly causing the death of N. Dharmendran are to be suspended from active duty, Datuk Seri Ahmad Zahid Hamidi announced today, fully 13 days after the 32-year-old died under their watch in a city lock-up. A government hospital autopsy report on Dharmendran revealed the detainee had died as the result of multiple beatings, triggering outrage from civil society activists and opposition leaders who pushed the authorities for swift action to prevent further custodial deaths. “It is in the process,” Ahmad Zahid, who is home minister, told reporters in Putrajaya today in response to calls to suspend the police officers on duty when Dharmendran died on May 21.

He said the authorities would not compromise on any case in which the detainees die while in police custody. Dharmendran was reportedly arrested on May 11 in connection with a shooting incident in Bandar Tun Razak and died ten days later while under remand at the city police contingent headquarters here. Kuala Lumpur Criminal Investigation Department chief Senior Asst Comm Datuk Ku Chin Wah had initially claimed Dharmendran died due to “breathing difficulties”. But a Hospital Kuala Lumpur autopsy report made public on June 1 revealed the former lorry driver for a waste management firm to have suffered “diffuse soft tissue injuries due to multiple blunt force trauma”.

The police have reportedly reclassified his death as “murder”. On May 28, Bukit Aman announced it had set up a special task force headed by Inspector-General of Police Tan Sri Khalid Abu Bakar to investigate the circumstances surrounding Dharmendan’s death. A day later, four policemen, said to have been on duty when Dhamendran died, were assigned to desk duties. There have been two other reported lock-up deaths since Dharmendran’s death.

Human rights society Suaram listed Jamesh Ramesh, 40, as having died at the Penang police contingent headquarters on May 27 and last Saturday, P. Karuna Nithi, 42, died at the Tampin district police station in Negri Sembilan.

According to Suaram, there were over 220 cases of alleged deaths in custody in Malaysia from 2000 to May, with its records showing that nine of those cases occurred in 2012 while eight cases took place this year. Another human rights group, Tenaganita, today criticised Putrajaya’s delay in setting up the Independent Police Complaints and Misconduct Commission (IPCMC) to address abuses and the growing number custodial deaths.

“We cannot condone another death in custody. We cannot allow the police to investigate their peers as it has not brought about accountability but instead an increase in deaths. “It is clear that the IGP and the home minister have failed miserably in dealing with deaths in custody,” Tenaganita executive director, Irene Fernandez, said in her statement. She also urged the federal government to ratify and implement without delay the UN Convention Against Torture “to reflect its political will to ensure citizens are free from torture by State and non-State actors”.

A United Nations Working Group on Arbitrary Detention 2010 visit to Malaysian prisons and detention centres reported in 2011 that between 2003 and 2007, “over 1,500 people died while being held by authorities.” The Malaysian Bar, civil society groups and several politicians from both sides of the divide have called for the IPCMC to be implemented to reform the police force since 2006. The IPCMC, which was mooted by a royal commission chaired by former Chief Justice Tun Mohamed Dzaiddin Abdullah but shot down by the police, was to be modelled on the United Kingdom’s Independent Police Complaints Commission (IPCC), as well as other police oversight bodies in New South Wales and Queensland in Australia, and Hong Kong.
